The Recommendation Letter and The Two College Admissions

This is pretty interesting. There are two different notes offered as exhibits to the Supplement.

Appellant's Exhibit 4 is a one page note that includes "Asia plus boyfriend saw him in the lobby 2:15-3:15." It is described in the Supplement: "Exhibit 4 is an additional note found in Gutierrez' file that shows her awareness of the McClain alibi."

Appellant's Exhibit 3 in Syed's Supplement to Application for Leave to Appeal the Denial of Post Conviction Relief, confusingly enough, has an "Exhibit 1" sticker on it. It contains handwritten notes, perhaps dated 7/13, perhaps 1/13, that mention "Asia McClean say him library @3." It's described in the supplement as "notes found in file of Syed's attorney Christina Gutierez (Exhibit 3 (admitted at post conviction hearing as Defendant's Exhibit 1))." When you go to the transcript from the post-conviction hearing, Petitioner's Exhibit 1 was offered but not admitted. It was described by Rabia "a page from a legal pad that I had made notes on when I met with Asia" PCR hearing page 53, 55. https://app.box.com/s/fh66s7ayt8gfmqtt39rkem3660u8btps

There was an Exhibit 5 offered at the hearing that was a note taken by Ali Cornedor, a law clerk for CG. (See Transcript, pages 4-5. https://app.box.com/s/6gufchridi0v033ewfuudgehy0al5j3w).

Exhibit 1 to the Petition for Post Conviction Relief is the "3:00" note, which is now Appellant's Exhibit 3. It's described in the original Petition as "Gutierez note" and it describes it as coming from CG's files but doesn't say who authored it. https://s3.amazonaws.com/s3.documentcloud.org/documents/1391660/syed-petition-for-post-conviction-release.pdf

The "2:15-3:15" note, now Appellant's Exhibit 4 isn't in the original petition. From what I can tell, it wasn't offered in to evidence at the PCR hearing. [I may be wrong, but I don't see it on the list of exhibits on the front of each transcript].

What did Serial say?

Deep inside Gutierrez's notes on the case--I have boxes and boxes of such stuff--there's this in her handwriting."Asia plus boyfriend saw him in library 2:15 to 3:15." [Which would match Appellant's Exhibit 4.]

Then there's another note, dated July 13. It's more than four months after Adnan's arrest. This is written by one of Gutierrez's law clerks, who visited Adnan in jail. Quote, "Asia McClain saw him in the library at 3:00. Asia boyfriend saw him too. Library may have cameras." [Which matches Appellant's Exhibit 3].

So, is Appelant's Exhibit 3/3:00 a note from a clerk, or notes from Rabia? And if Rabia, it appears they are from the post-verdict meeting that culminated in the affidavit. If they are Rabia's notes from meeting with Asia after the verdict, and Rabia thereafter provided a copy to CG, or else stored them in CG's files after CG was terminated, what relevance would they have to show what CG did or didn't know about Asia before the trial?

And is Appellant's Exhibit 4/2:15-3:15 the notes from the clerk or "in [CG's] own hand?

If Appellant's Exhibit 3 or 4 was in CG's own hand, why wasn't it offered as such at the hearing? (or was it and I'm missing it?)
