Report: Manning alleged assault cited in UT suit

Here's the truth:

I'm sure this'll be deleted like the SI article last night that posted a whole list of court documents (Here), but last night I grabbed the related text from the original August 27, 1996 case, which said: On February 29. 1996, while I was performing therapy on a student athlete, XXXX, he pulled his pants down and exposed himself to me, as I was bent over examining his foot after asking me several personal questions. I reported this to my supervisor, who referred to it as “merely a prank”, and no action was taken in regard to this until after I formally complained. l have been on medical leave ever since this incident occurred. Ms. Whited identified the student as _. Ms. Whited stated that _, asked several questions- such as who she “hung out with”, what she did on weekends—that she felt were inappropriate. She stated that she was working on foot when she heard laughter and looked up to see his exposed rear end. She stated that she pushed and said "You’re an ass;” Another student, _, was present in the immediate area. Findings

Ms. Whited reported the incident to a friend who then called Mike Rollo. Mr. Rollo met with Ms. Whited, Mr. John Whited (Jamie Whited’s husband), and the friend at the friend's home. Mr. Rollo then went to _______ apartment to discuss the situation. _______ stated that he was surprised to find out that Ms. Whited had seen him pull down his pants and was also surprised to hear that she was upset by it. He stated to Mr. Rollo that his actions had been directed to who had made a comment about _: girlfriend. _ stated that Ms. Whited said nothing and gave no reaction. He, _______ and Ms. Whited remained in the training room for approximately 10-15 minutes after that. _______ stated that they had been talking to Ms. Whited prior to the “mooning” incident, and had asked her whether she “hang(s) out with people she works with.” According to _______ Ms. Whited responded by saying “Hell, no. Would you?” He then asked her who her friends were in the department. This was the extent of his personal comments. _______ corroborated ____’s account of the event. ____ called Ms. Whited to explain his actions alter Mr. Rollo met with him, but her husband answered and stated that she did not want to talk to _. On Friday, March 1, I996 _ attempted to speak with Ms. Whited at her office, but she was not there. He made several further attempts to contact her by telephone, but was unsuccessful. Mr. Rollo stated that he reported the incident to Coach David Outcliffe. A few days later, Coach Fulmer was informed of the incident by either Mr. Rollo or Coach Gary Wyant. On March 12, I996, Coach Fulmer wrote a memorandum to _, that outlined disciplinary action to be taken against as a result of the incident. The punishment included removing his privilege to eat at the athletic facilities dining room, and requiring him to run at 6:00 am. for two weeks under the supervision of Coach Cutclitfe. The prohibition from eating at the training table was later reduced to two weeks. Coach Fulmer also advised _ to make amends with Ms. Whited. Coach Fulmer took these actions based on his investigation of the incident and on _'s lack of a disciplinary record. On March 13. 1996, _ was contacted by Coach Fulmer who advised him that he would be disciplined for the February 29 incident. On March 14. sent a registered letter to Ms. Whited in which he apologized for the “misunderstanding”. Ms. Whited did not report for work on March 1, 1996. In a memorandum dated March 6, 1996, Ms. Whited advised Mr. Rollo that she needed to be on a medical leave due to the incident involving _______. While Ms. Whited was on medical leave, the University continued to try to address her concerns about this incident as well as other general issues. Those efforts are described in more detail in the chronology of investigative events. Ms. Whited returned to work status on May 27, 1996. She was given a special assignment that allowed her to provide assistance to the track and field Olympics in Atlanta. The assignment extended through August 6, 1996, at which time she was to return to her regular training duties. Ms. Whited returned to the Athletics Department on August 12, 1996. Analysis

_______ denied that he directed the “mooning” at Ms. Whited and a witness corroborated his account. Coach Palmer took immediate disciplinary action against _______. Athletics Department also took appropriate actions to address Ms. Whited’s concerns. This incident appears to be another example of horseplay that cannot be prevented, yet disciplinary action was taken to address the inappropriate behavior. In this context, the action was not sexual in nature or directed at Ms. Whited; and was therefore not sexual harassment. The TL;DR is her allegations in August, 1996 were that Peyton mooned/flashed her.
