I'm not sure I follow. You're suggesting that the Ban Lists should amount to a popular vote, and then bemoan Wizards decision-making being based on catering to the most people to buy the most product. Wizards market research amounts to a popular vote.

Standard's only bans in the last decade were JTMS & Stoneforge 5 years ago. The legacy ban list is not controversial, and is largely supported by the players. Wizards is fine there. The Commander ban list is all kinds of inconsistent and a constant source of bemoaning. It's not like the unaffiliated party is doing any better here.

You're really just bemoaning the modern ban list. Modern has struggled with its ban list because (a) it's a young format where (b) new cards are being injected that (c) follow recent design philosophy that states counter spells & land destruction are un-fun.

As long as threats are unequivocally better than answers, modern the will periodically break because there's a new oppressively best deck. It doesn't matter if Wizards, the DCI, or you in your infinite wisdom come up with the ban list. The problem is the answer cards that do not exist, so the only option is to ban the worst offenders until there's balance. And that balance is really delicate.

Legacy has no problem because Force of Will checks the glass-cannon combo decks. Glass-cannon combo decks check the brainless aggro decks. Wasteland checks greedy big-mana decks. So, as a result, most people end up playing fair decks that do lots of things - and it's fun. The only problem with it is that the Reserve List ruins accessibility and the format is warped around brainstorm (for better or worse).

Modern would be just fine if FoW, Wasteland, Cabal Therapy, Vindicate, and Counterspell type cards were legal in the format. You could un-ban basically everything on the list save Skullclamp.
