Elizabeth Warren agrees Texas abortion law is like The Handmaid’s Tale. ‘When abortion is illegal, rich women still get abortions’

This is so much worse than anyone realizes. The abortion law is monstrous, I'm not defending that. I'm saying everyone is so emotionally caught up in this that it's all they're seeing...for now at least. The reason the SCOTUS didn't pass an injunction stopping this is because they can't per the 11th amendment and ex parte Young. This is a question that hasn't been asked before. This law deputizes citizenry and specifically says that the state or it's representatives are not enforcing this action and that's to prevent the federal courts from issuing injunctions among other things.

US law is based on precedent. What happens when other states adopt this law for their own ends? California doesn't outlaw guns but let's people sue if they find someone who owns one. Virginia doesn't ban free speech but anyone who speaks out against the president or protests can be legally liable.

There's no precedent for this or legal mechanism to combat it. Our entire system of law was just stabbed in the chest and (putting aside that the clinic didn't have standing to request an injunction) of the Supreme Court takes it out wrong, it's going to bleed out. I strongly suspect we just found Kurt Godel's loophole or something very close to it. It couldn't have happened at a worse time. This is terrifying.
