Gabba red light

The gist of it is if you were behind the solid white line and crossed it while the light was red, that's an offence. If you had stopped past the white line while the traffic was green (but not in the actual intersection) and drove forward. That's an offence...

If you had stopped in the intersection while the light was green, it changed to red, then you drove forward to clear the intersection. That's completely legal. But entering a congested intersection in the first place is an offence.

Either way you are pretty much f**ked. Either it's a red light ticket or entering a congested intersection which from my memory is roughly the same penalty. That being said, the red light is considered a 'LEO' offence which means that no matter which way you split it, if the offence can be proven then a TIN must be issued, no warnings possible.

Now according to the QPS Traffic Manual Chapter 8.8 a warning can be issued for entering a congested intersection.

If you could argue this point with the traffic camera office the issued infringement notice will be suspended while this is going on, they may just bust it down to an official warning depending on the circumstances of the offence.
