I'm going to make a hypothesis of what happened when you learned that several senators voted for this 'unconstitutional' idea. You became confused, because - according to the knowledge you have - what they were voting on is totally unfeasible. You reconciled this confusion in the simplest way that people naturally resolve confusions: you decided the other side was wrong. You didn't think "maybe they have knowledge I lack" you didn't think "maybe the knowledge I have is erroneous in some detail" you decided, immediately and automatically that the senators who voted were being absurd.

Because doing otherwise requires effort. This is why you're not supplying any self containing reasons why it's infeasible. You haven't explained why we'd have to throw out the constitution. What you know tells you we'd have to do that, but maybe there's more to what you know than what you know.

Imagine a person who's understanding of water comes entirely from dropping various dense objects into a pool. The person runs a hundred experiments and deduces that all objects sink in water. When presented with a low density object, such as a hollow plastic ball, the person refuses to believe the ball will float. Floating is, obviously, impossible. No object that has ever been tested could float. If the ball could float we'd have to totally rework our understanding of water/object dynamics. It would be new and difficult.

The ball floats regardless, because while the statement "objects sink in water" holds true for some objects, it does not hold true for all of them. A more correct statement may be "objects sink in liquids less dense than them and float in liquids more dense than them" but even this barely scratches the surface of what's going on. There's is more to water than what the man knew about water.

So when you first heard about this proposition, did you take the time to check your beliefs about the feasibility of the proposition, or did you assume you already know a sufficient amount despite encountering a scenario which didn't fit your mental model?
