NOTICE TO VACATE

As <management company> desires to have again and repossess the premises situation at <our address> which you now hold of us as tenant, you are hereby notified that your lease agreement for these premises is terminated effective 12:00 am April 10, 2015 and we hereby give you notice to remove and quit the same in accordance with the termination provisions of the lease, which will be April 10, 2015. The notice to vacate is given to you as a result of your breach of the covenants and conditions of your lease agreement specifically the following paragraphs:

20 - PROHIBITED CONDUCT: You and your occupants or guests may not engage in the following activities: behaving in a loud or obnoxious manner, disturbing or threatening the rights, comfort, health, safety, or convenience of others (including our agents and employees) in or near the apartment community; disrupting our business operations, manufacturing, delivering, possessing with intent to deliver, or otherwise possessing a controlled substance or drug paraphernalia, engaging in or threatening violence; possessing a weapon prohibited by state law, discharging a firearm in the apartment community; displaying or possessing a gun, knife, or other weapon in the common area in a way that may alarm others, storing anything in closets having gas appliances, tampering with utilities or telecommunications, bringing hazardous materials into the apartment community; or injuring our reputation by making bad faith allegations against us to others.

24 - RESIDENT SAFETY AND PROPERTY LOSS: Casualty Loss. We're not liable to any resident, guest, or occupant for personal injury or damage or loss of personal property from any cause, including but not limited to; fire, smoke, rain, flood, water and pipe leaks, hail, ice, snow, lightning, wind, explosions, earthquake, interruption of utilities, theft or vandalism unless otherwise required by law. Unless we instruct otherwise, you must for 24 hours a day during freezing weather 1) keep the apartment heated to at least 50 degrees; 2) keep cabinet and closet doors open; and 3) drip hot and cold water faucets. You'll be liable for damage to our and others; property if damage is caused by broken water pipes due to your violating these requirements. If you ask our representative to perform services not contemplated in this Lease Contract, you will indemnify us and hold us harmless from all liability for those services.

Your breach of the covenants and conditions of your lease consisted specifically of the following:

You or an occupant or co-tenant were told to keep the water to your unit off while the pipes to the building were frozen. You or an occupant or co-tenant turned on the water to your hot water heater which caused damage to your unit and to the units below.
