Just file a FOIA. The USPTO invoked the media policy related to the Remsen event. “All USPTO employees, with the exception of the USPTO Director and Deputy Director, are not permitted to be interviewed by any news media outlet in your capacity as a USPTO employee about USPTO-related subject matter without the express prior approval of the Chief Communications Officer.”
It thus Follows that they are declaring the incident a matter related to examiners' official capacity as USPTO employees.
Logically they either have documents related to the event that support such a decision or it is a frivolous assertion. A FOIA would force a response. The USPTO would thus have to release documents, rescind the assertion that the Media Policy applies, or provide an explanation how the event is related to employees official capacities AND why any documents are not subject to a freedom of information act. All of these outcomes would provide information.
