Single owner auto body shop has a shared wall with our business. He is killing us with neurotoxins.

Here's a facebook post from April 2015. This is really what started me getting serious about this. I just felt like reposting. It doesn't change anything about my original question, and we've been far down the road since then through proper channels and authorities.

TLDR: Auto body guy nearly kills my partner with toxicity.

"I do not wage war easily. Today, I'm declaring war.

I came to the back to the lab at 3 after being away for five hours. Later after the "incident" my partner asked what it smelled like when I opened the front door. I said, "When I opened the door an image of a dead guy sitting in the front seat of his car enclosed in a garage, with the motor running all night came into my mind".

The guy next door owns an auto body shop. Since we moved in, we've had problems with fumes. This guy is yellow. Like YELLOW. His skin, his eyes, his fingernails. He has not been using any kind of safety measures I'm guessing since he opened his first shop in the late 60's. The neurotoxin levels in his brain and body show up on every once human level. He's paranoid, unreasonable and unpredictable. We've gone through all the neighborly routes. The property manager even put up more cinder block reinforcement to try to alleviate the issue.

He denies any wrong doing and claims that we are making everything up.

When I walked in today, my partner was sitting at the desk in a stupor. I'm not exaggerating. He was confused with glassy eyes. He was sluggish and only snapped out of it when I yelled "Hey! What's going on? Why are you sitting in here in these fumes?" I got him up, propped open the front door, turned on the fan and the lab fume hood to clear the air.

And then, I marched next door, and was not a nice neighbor.

He again said he wasn't doing anything. There was no smell. And, that it was probably us doing something in our lab with chemicals trying to blame things on him. He said we were making everything up because we have a vendetta against him and that I don't know what I'm talking about because of all the weed I smoke all day (we own a marijuana business. It is a lab. We don't grow, sell or smoke weed).

I made clear that this is unacceptable and would not be tolerated going forward, I was not going to listen to him further and the next time this happens that the Health Department would be showing up. Except, I should have typed that in all caps because I yelled it with a red face and shaking hands. I turned around and stomped out with him leaning out his door screaming "FUCK YOU!".

I'm still pretty furious. Also, I've been told since then that the next time this happens, I should call the fire department.

It took my partner two hours to get close to normal. And he was left with an unresolved headache at least six hours after the fact.

I don't want to abuse 911. This is really dumb, and this guy is an ass. Taking into account that all rational options have been explored, is calling the fire department next time this occurs the thing to do? I think so, but I hate going down this route. It's really gross.
