Star Wars: Knights Of The Old Republic is getting a Unreal Engine 4 remaster

That is, if it's just an application which takes the original KOTOR files installed on your system and reorganizes them to be experienced on a different engine, then that is not unlawful, as the software is not distributed with any intellectual property.

Real-world precedents of this (which, granted, are still iffy) are: SWGEmu and Tale of Two Wastelands.

SWGEmu requires that the original Star Wars Galaxies client be installed on the player's computer. The application copies and modifies the original client's files so that the client can connect to alternative servers. The only breach of legality here is that playing a modified client breaches the EULA of the original Star Wars Galaxies game (and perhaps all SOE/Daybreak games), so by using SWGEmu, SOE/Daybreak has the right to terminate your account with them. (Which may cause you to lose access to their other online games which are still active such as Everquest.)

The actual server software may be a different story, though. The game server database must contain the names of places and characters who are trademarked by Lucasfilm/Disney. So in that regard, I could see a case against those who operate SWGEmu servers, but not as likely those who create the SWGEmu client itself.

Tale of Two Wastelands requires Fallout 3 and all its DLC and Fallout New Vegas and all its DLC be installed on the player's computer. It is simply an application that copies & modifies Fallout 3 and New Vegas files to allow Fallout 3 to be effectively loaded as a mod in Fallout New Vegas, allowing you to play both games on the marginally superior New Vegas engine. This is also legal as no content which is the intellectual property of Bethesda is distributed with the application. And as far as I know, it doesn't breach any sort of EULA (not that it matters, as the Fallout games don't have an online account associated with them for Bethesda to cancel).


In the end I'm mostly just spitballing because, as I said above, IAANAL.
