It's not only the foam, but the box lid layout. How do you think Apple would respond if another company copied the box design for the iPad? The way Jaycar copied the exact size of the box,the cut outs on the lid, in addition to the foam (I mean, this is exact same placement of each of the various components when it would have been just as easy to have different layouts since it's not like the various components naturally and heavily favor that particular layout and the same exact dimensions; with that in mind, it's very reasonable assert that a customer could be easily led to believe that the Jaycar product is a merely a generic version of the Freetronics product, where Freetronics merely purchases the assembled product and just slaps it's brand name of the box. It's also very likely that the owner of Freetronics designed each individual project (the particulars) and the lessons on his own, including the order or sequence in which they're presented to the customers, especially the more involved or advanced projects, based upon his own assessment of how best to teach the customer about Arduino. If that's also the case, there's also could be copyright infringements on the table, very similar to college texts books, especially regarding science texts that include lab projects.
