Weekly Stupid Questions Thread - 31 January 2016

I posted these questions elsewhere (deleted a thread because it became irrelevant), but I want to ask again.

So, I'm quitting my job at the school that made me pretend to be a clueless gaijin ("When we speak to the students in Japanese, just pretend you don't understand.") in addition to other more subtle forms of mental abuse (and, yeah, I'm sticking with the word "abuse" here).

  • I asked about time off. My boss said, "Your contract said you get holidays off. That was your 有給休." I explained that this was never explained to me, I was never asked if I wanted to use those "holidays," and that I need to see something in writing. Others have talked about such "prearranged" paid leave, but I was never even informed that I had paid leave. Is this just something they are allowed to do? Give me paid leave days without my knowledge or consent?

  • Kenko-shindan. I asked about it, and they didn't even react. I was worried that if I mentioned their illegal behavior, they would take it as a threat. Quite the opposite: boss calmly said, "We don't do kenko-shindan for foreigners." She seemed more shocked that I expected to get one. Nothing I have found indicates that the kenko-shindan laws are based on nationality. Can anyone confirm?

  • Image rights. My bosses took photos of me for their pamphlets and posters. I was never asked if this was ok, it was not in my contract, I signed nothing. I was merely told to do it. Now that I'm leaving, I asked them to put some kind of agreement in writing regarding the use of my image. Does anyone have any advice for what I should ask for here? Are companies just allowed to use your image like that just because you're an employee? Is this something I could demand compensation for? (I'm really, really, really not happy about this one, and would be willing to push the issue. They put my fucking face on TV without asking me if it was ok.)
