Did CNN blackmail a user on Reddit over a GIF and was this a good thing? Let's see what Reddit thinks.

Allow me to direct your attention to laws that CNN violated in NY alone and the potential violation of federal laws.

First, from the facts presented, CNN violated § 240.25. Harassment in the first degree:

"A person is guilty of harassment in the first degree when he or she intentionally and repeatedly harasses another person by following such person in or about a public place or places or by engaging in a course of conduct or by repeatedly committing acts which places such person in reasonable fear of physical injury..."

Second, from the facts presented, CNN is guilty of stalking under New York statutes for tracking down and contacting the user:

§ 120.45. Stalking in the fourth degree

A person is guilty of stalking in the fourth degree when he or she intentionally, and for no legitimate purpose, engages in a course of conduct directed at a specific person, and knows or reasonably should know that such conduct: 1. is likely to cause reasonable fear of material harm to the physical health, safety or property of such person, a member of such person’s immediate family or a third party with whom such person is acquainted; or 2. causes material harm to the mental or emotional health of such person, where such conduct consists of following, telephoning or initiating communication or contact with such person, a member of such person’s immediate family or a third party with whom such person is acquainted, and the actor was previously clearly informed to cease that conduct; or 3. is likely to cause such person to reasonably fear that his or her employment, business or career is threatened, where such conduct consists of appearing, telephoning or initiating communication or contact at such person’s place of employment or business, and the actor was previously clearly informed to cease that conduct. For the purposes of subdivision two of this section, “following” shall include the unauthorized tracking of such person’s movements or location through the use of a global positioning system or other device. Stalking in the fourth degree is a class B misdemeanor.

This stalking in the fourth degree moves up to the first degree; if the CNN employee was over 21 and contacted a child under 17.

Third, assuming /u/HanAssholeSolo is under 17 years old, CNN likely violated N.Y.P.S. § 260.10, Endangering the Welfare of a Child:

"§ 260.10. Endangering the welfare of a child

A person is guilty of endangering the welfare of a child when: 1. He or she knowingly acts in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old or directs or authorizes such child to engage in an occupation involving a substantial risk of danger to his or her life or health... Endangering the welfare of a child is a class A misdemeanor."

Any CNN employee involved in this heinous and malicious activity should be prosecuted under all four of these statutes.

The first question is jurisdiction, because federal courts are limited jurisdiction. We would need the CNN actor to be in a different state from Han (which is likely). If that's the case, CNN likely violated 18 U.S.C. § 875(d):

"Whoever, with intent to extort from any person, firm, association, or corporation, any money or other thing of value, transmits in interstate or foreign commerce any communication containing any threat to injure the property or reputation of the addressee or of another or the reputation of a deceased person or any threat to accuse the addressee or any other person of a crime, shall be fined under this title or imprisoned not more than two years, or both."

Han's apology letter which asks everyone to stop "ugly social media behavior" is certainly a "thing of value" to CNN, and CNN's doxxing threat was to "injure the... reputation" of the addressee (Han). From the facts provided, I think this statute fits well. In that case, CNN would likely be guilty of violating 18 U.S.C. § 880 (Receiving the Proceeds of Extortion) as well.
