My company is making changes to new federal FLSA law coming into effect Dec 1st that I'm unsure are necessary. Just need some explanation of the new laws based on our specific situation.

That's not really how early intervention therapy works or our scheduling system. If someone works 46 hours making up billable hours they lost, that person likely still has to keep their schedule the same the next week in order to maintain the hours they need to get with the child within a 6 month interval. Because it's likely if someone is making up billable hours that they can't afford to lose billable hours the next week. We assign hours every 6 month interval and our goal is for everyone to meet those assigned billable hours. If everyone is not meeting their assigned billable hours the company loses money. I just don't see the difference if they assigned a salary for 37 hours vs hourly for 37 hours, because people are going to be working overtime either way, but the 37 gives a buffer in both cases. I don't anticipate anyone assigning fewer hours a week after if one week is higher. That's just not the way things work in the company and aren't likely to change even with this new law.
