Account Hacked - Blizz won't return characters transferred to new account

I really don't understand why they won't return your character to you. It seems that you've adequately proven that you are who you claim to be (ie: Not a dead woman), to the point that they've already done a partial restore of your account. So why doesn't Blizzard just go the full hog?

They know that the character originated on your account. You've made the claim that you've stopped playing. They will have records of when your payment information changed (for legal compliance), assuming that you mange the bank account that was previously associated with your WoW acct. Which means they would be able to cross reference the move date with a time that a reasonable person could assume you lost control of your account - meaning, that is proof that you did not initiate the character transfer.

SO with all of that... * Proof that someone fraudulently accessed your account (your verification that you are not, in fact, a dead woman), and * That someone used that fraudulent access to move the character off without your knowledge (The date of when the payment information originally changed referenced to the date of the transfer request being initiated

you would think that it's a simple thing to simply initiate a freeze on the other person's account, and then transfer your character back to you. It doesn't matter if he's a subscriber or not - you've got proof that the character is yours, and that he obtained the character though methods which violate Blizzard's ToS (for all intents and purposes, what he has done is on par with selling the character; taking access from the person who has rightful access, and giving that access to another person for personal gain).
