It would be a solution, but in figuring out checks and balances, cost has to be a consideration. I would imagine cost is a significant barrier to an employee seekingegal advice. There is also a psycological paradox of employees not wanting to make a big deal out of it and involve lawyers, despite it being bread and butter lawyer territory.

Mandating employers pay for independant legal advice would also be a non starter for employee groups who claim their HR departments act independently, and anything even remotely sounding like mandentory Unionism is politically unpalatable in a world where Fair work discourages lawyers.

Perhaps a solution may be that employers must pay for up to $5k for that legal advice... that might sound a little nuts to some, but if the offer is substantial enough that may we be the nudge and support a victim needs.
