You already answered you own question: Due to the lack regulations and legislation, ESA designation is abused by people like OP.

I do not quarrel with the idea that some animals can provide some mental health benefits for some people. But we do not know if this concept applies here. According to her own comments, she was only recently “prescribed” an ESA. She has not even chosen an ESA and has no evidence that it will benefit her mental health. Therefore, she is trading a possible benefit (to herself) for a known determiner (to her roommate). She is being selfish. Do you think a selfish person will actually be a good pet owner?
