Ask anyone you know what would happen if they, like Hillary Clinton, exclusively conducted their employer’s business on their own email server and you will hear, even among Mrs. Clinton’s supporters, that they would eventually be exposed, undoubtedly fired, possibly prosecuted.

Just as a counter point(not arguing which is better or worse for SCOTUS appointments), Hillary could very well appoint a SCOTUS that is VERY pro NSA(or FBI) that could heavily damage the US as well(so could Trump too - once again not arguing who better).

My point is, saying anything on this is kinda claiming you know the future. We have no idea what will go to the SCOTUS and what they will end up deciding on(and Judges aren't always what the president thought they would be and even change over time).

I'll agree we can make some educated guesses about some possibilities but the reality is there so many variables to claim anything with certainty. Hillary could ruin the country with her appointments too.

I think the most important issue(that is divided) would be global warming and I doubt this will be a SCOTUS issue decided by party alliance. But, NSA and government surveillance I feel both are dangerous, same for the 1st... Equally applies to the 4th as both are dangerous here too. Not often you get a challenge to the 5th but I would bet money both would be against one if it came up(see jailing people for not giving up encryption passwords).

Depending on what comes up I feel we're going to lose no matter which one wins as far as SCOTUS goes. I would bet the big challenges we will see are 2nd(obviously), 4th(which seems to be lose lose no matter who wins), maybe 5th and, minority rights - saved for last because THIS is the one I think Hillary will be better on BUT I am a 2nd supporter too(actually I support the whole damn thing and not cherry pick what I like and don't like) so honestly I say "I have no idea who is going to be the right one for SCOTUS" - they are both shitty in every way.
