Going to throw this out there, and welcome the downvotes because it's not a popular opinion.

  1. Just like having sex with children is illegal in western countries, having sex outside marriage is illegal in some middle eastern countries. First point.

  2. Rape is also illegal in those countries.

Did the woman get penalised for 1 or 2? Did the male get penalised for 1 or 2?

As I understand it, the female was penalised for extra martial sex in which case she was breaking a law, but there was an acknowledgment that rape took place for which she was not penalised for and it was acknowledged she was the victim too.

The male was penalised for 1 and 2, i.e. both extra marital sex and the worse crime of rape, in both cases not a victim but perpetrator.

Being a victim in an incident may not always absolve one from being a perpetrator for something else.

We have this all the time in The West also.

A woman is raped during a drug filled orgy. She may be a victim of rape but will be charged for possession and use of highly illegal drugs and its distribution.

A man who is is beaten to a pulp after hurling racist abuse at someone may still be the victim of grievous bodily harm but the perpetrator of a racist crime.

Yes, you can argue about the law against extra marital sex, but that one is up to their country. What is not happening is that people are being penalised for being raped.
