California lease (tenant) - how do contingency cases work with lawyer cap clauses?

I sure do. Case 1 is 7 figures, i had moved in here straight from a 6 year exposure i was not aware of and there was lead dust there and chipping paint, Contingency attorney for that case which is current will not respond to me other than to say it will mess up my current active case with him for the 2014-2020 exposure I had before living here. I cannot move on since I have already done a deposition with that one, but I am not getting advised exactly how he wants me to “not mix the cases up or email your doctor or landlord about mold.”. I’ve emailed him yesterday saying my dr wants me to get independent testing asap (which i’m doing tomorrow since he didn’t answer) and this is driving my desire to understand the situation, I have been looking for a lawyer for this current exposure so I can stop dealing with lawyer 1 who used to respond and stopped recently.

That case 1 has another deposition for me and I still haven’t sent them all my credit card statement with costs etc. I am nervous and don’t do well with trying to figure out how to “not mess it up” without him telling me. I have legitimate ptsd from this and i told him I did not want my therapist records involved in case 1, he said he would send me to a therapist. I went once, he kept saying he was gonna send me again but he never did and the therapist never called me.

Now he has subpeopned my therapist records, won’t call her to hear her out on why she does not want to include them which i have asked him to do for months and now somehow his answer about this now is “well it’s a subpoena she has to turn the records over by law.”. I am nervous even posting this on She had sent a summary around August when my 1st deposition was and what I just said is where it’s been left as far as he’s concerned.

I am nervous even writing this here but i appreciate your answer so much i wanted to be transparent .

I have more than $250k ahead of me to get better from this 2nd exposure - especially because i think this one has stachybotrous and my last apt did not but neighbors had it.

Essentially you are saying that it will be hard to enforce those 2 lawyer caps on the leases with large financial damages in excess of $250k correct?
