I'm an IP attorney. Not every single thing you write is copyrightable. Single words, as I said, are not. Trademark doesn't apply, either. Trademark isn't really an area of IP, it's a consumer protection law. If you're not using the word in commerce, trademark provides no protection.

And even then, it is only available for the products it is used to identify. Wrong.

There is an exception for certain famous trademarks. But for the majority of trademarks, there is only protection within particular categories of goods. For example, if you make a soda called "Covfefe" and trademark it, I can then make toothpaste called "Covfefe".

Actually, that's a rather good definition of "lawful" as applied to the government. But do tell, in what meaningful way could anything be said to not be "lawful" for the government, if the government always does it?

"Free speech" in this context is a federal constitutional question. States do not have final authority in interpreting the meaning of the federal constitution. Any arm or level of government has preliminary authority to interpret the Constitution, but until the Supreme Court addresses the issue it is unresolved.

No, learned it in law school. Cake bakers are not state actors, they can never violate your Constitutional rights. This is a basic conlaw101 concept. I have no idea what you're trying to say, otherwise.

I'll rephrase for you: there is absolutely no conceivable law that would prevent anyone at any level of government or private practice from repeating anything the President says publicly. How's that?
