You are not required to carry identification in America nor are you required to identify yourself unless you’ve been detained for suspicion of a crime, including simple traffic infractions. If the officer detains you because he reasonably believes you may have just committed a crime, are currently committing a crime or are about to commit a crime, then yes, you have to ID.

If you’re a passenger in a vehicle where the driver is stopped then you don’t have to identify yourself. If the officer says “do you have any ID on you?” or “can I see your ID?” it’s not an actual demand but a request. If you then ID yourself (verbally or handing over your ID) you just did so voluntarily.

Could you say “naw, I’m good?” Absolutely. Now if he makes a demand then ask the simple question “am I under suspicion on a crime?” If he says yes then you have to ID yourself. If he says no, politely decline.

Do I try to ID everyone in a car? Absolutely. Why? Because that’s how you catch wanted persons. Have I had people refuse to ID themselves? Again, absolutely. And no, I don’t get upset. I wish 100% of the population knew their constitutional rights. It would honestly make my job a lot easier. That way when people holler “I know my rights man!” Then I can remind them that if they know their rights then they also know case law and what the courts have deemed permissible and you can stop arguing while I do my job.
