We told our realtor we did not want to pay the $295 broker fee. We haven’t signed anything with him but he has signed the new construction contract for our new build, saying we signed under him. Also, he won’t stop texting us after we told him not to. What do we do? Will he get his money?

Like I said, these things are legally complicated. I am from Texas. I can charge fees to my client if I want to. People can pass broker fees on. You are a client of the BROKER usually, not the agent. So a broker fee could very well be assessed. You probably should have been made aware of that, but again, whether or not something like that has to be disclosed depends on your state’s laws, which we cannot help you with.

In my area, if we are under contract and I was the buyer’s agent when we went under contract, there’s a good chance I’m entitled to compensation at closing.

Does the agent have a managing broker? Talk to them. Ask to be reassigned.
