Can My Job Drug Test Me Without Me Signing A Consent Form?

Yeah, I'm well aware about the thc and fat thing. Only thing is I passed a test 28 days after 8yrs of chronic use and only had been using for a few months this time and didn't expect to be dirty for nearly twice as long.

And I obviously don't expect you to know that info about the company. I was more or less looking for an opinion or something based off previous experience. Is it common for companies to have drug testing policies requiring a pre-employment test that they just don't enforce? Is there a way they can get whatever benefits they get from testing (insurance or whatever) by just putting it in the policy and not enforcing it? Is it common to do a drug test randomly after hiring someone, let alone after a background check? Which is a more drawn-out and expensive process?

And also, if after a certain period of time aren't I considered "hired" if I started getting paid and working there? Can they come out of nowhere with a "pre-employment" test after I've been working there for some time? And I'm still protected based on their own policy if I choose to medicate again. The policy says nothing about a random test, if I don't appear intoxicated, injure myself, and if a contractor doesn't request one, but I still somehow get tested and fail, do I have any form of defense? Since it's only those three specific scenarios in the contract so any other reason would be bullshit.

I understand you guys can't answer my questions to a T I'm just looking for opinions or advice.
