As someone who deals with insurance companies on a daily basis let me tell you how the landlord is still fucked. He'll get paid and be protected personally but the fucking insurance company is going to settle any injury claim depending on tolerance. Lawyers will still sue the landlord which the insurance company will pay a lawyer to defend. All this gets recorded and the money will add up. The insurance company will then use that during their assessment when the landlord renews the insurance and raise his premiums. If the landlord tries to switch insurance companies then the next insurance company will pull the loss runs from the other insurance company and keep the higher rates too because this house is now a risk and has cost the other insurance company X money. So yeah, landlord isn't at fault nor should the insurance company pay out but they will because it's cheaper then defending multiple claims in long drawn out legal battles with the potential to lose. Landlord will probably see 10-30% increase in rates next year.
