First The GOOD NEWS. First I'm 80% sure the Joe doesn't know that he isn't the father even though she said that he accepts the child as his.

The BAD NEWS is the above was the ONLY good news and the rest is the SCREWED IN THE ASS BAD NEWS.

What you have is a lose-lose situation.

If you reject her, she might get mad and file for child support from you.

If you sleep with her,

  1. Worst case: her husband may find out and/or she will fall in love with you or for some other reason, they will get a divorce. Her husband may contest paternity. If he wins and relieved of all parental responsibilies, she is definitely going after you for child support.

  2. Best case: she eventually goes back to her husband and he doesn't know and no one is none the wiser And you have to live with the fact that at anytime for x years(which is determined by your state) she can at anytime sue you for child support and back child support.

Best case is a miracle. I've never seen it happened(but I want to believe that it can happen).

So yea. Go talk to a lawyer about how long it would take to establish "acknowledge paternity"

One last piece of advice. If you do end up sleeping with her, wear a condom.
