President Obama, close the 'gun show loophole'

You don't have the right not to be searched, the 4th amendment protects the right not to be searched unreasonably. The 2nd amendment contains no such language.

When a person files a restraining order against you they present evidence at the time of filing. A judge may issue a temporary restraining order based on the petition without ever speaking to the application or the person in question. Upon being served with the temporary restraining order you must, if decided by the judge, turn in your fire arms to the police department within 24 hours regardless if the claims against you are true or not. You will get a hearing which is normally in 21 days and you must proof that you turned in your gun or you are not in possession of a firearm. Then they have the actual hearing and if the judge decides a restraining order is not needed you can then get your guns back.

This isn't the new California Law this is ever state's law when it comes to restraining orders and domestic violence. Yet I don't hear anyone crying about due process or violation of the second amendment.

So, again, without ever having the ability to face your accuser or defend yourself you MUST turn in any gun within 24 hours. Plenty of people are falsely accused of domestic violence every year and I don't see anyone picketing or going to the Supreme Court about it. Why? You answer this question.

So when California essentially expands this to people who are a danger to themselves or other people the right wing and the gun owners of America get all up in arms despite that it essentially mirrors domestic violence restraining orders procedures in all states.

The 4th amendment protects you from unreasonable search and seizure. And if courts have ruled that it is reasonable to seize a gun from someone accused of domestic violence then it is reasonable to seize a gun from someone who is a threat to themselves and/or other people.
