Biden to propose overhaul of immigration laws on first day in office

most are just trying to do their jobs

Facts. If it helps, the division I support spends most of its time trying to find reasons to leave people alone. Even so, I really tried not to take this job. When you're 6 months out of school and still looking and they offer you a clearance, though, there's only so long it's reasonable to resist.

Aaaand I'll be deleting these comments after this conversation, I think.

If it helps, most of the people I work with are very aware that some other parts of ICE do terrible things, and so we're very careful about referring people to field agents to go have a chat. We're generally much more concerned about national security flags than rule-breakers, but I've definitely had some serious talks with co-workers about the morality of doing anything for this agency. Hopefully that will get better now that Biden is taking over.

It sounds like somebody at the border figured that since you and your ex are divorced now, that it may have been a fraudulent marriage in the first place. I agree that it's really not their call, especially after you've had permanent LPR status for *15 years*. Afaik you should be able to file an I-765 to get work authorization while you wait for your court date, at least. That's something I see a lot. It's kind of bullshit, but worst case scenario you could file for asylum and get work authorization while waiting for THAT to process. That's almost an auto-grant situation. (I just re-read. Glad you have a solid job and don't have to worry about getting work auth for the moment.)

Based on what you've said, I really doubt you'll get deported. Immigration judges tend to take their role really seriously. I think it's pretty likely that the judge will see that it was a bullshit referral, and that you have kids and that you've been here a long time and understand that sometimes shit happens and marriages end, even ones supporting someone's immigration status. In that scenario it's pretty likely they'll rubber-stamp you back into status.
