At the core of the case here is mens rea - whether Hillary Clinton knowingly had classified material on her server. If she did, then that establishes intent, which is the key differentiating factor here. Of the emails that contained classified information (and if nothing else, this should convince everyone that our classification system is a clusterfuck), three of them had (c) markings indicating that it was classified. That's why those three emails were important.
