The majority of this case, assuming it goes to trial, will be whether prosecution can establish the requisite mens rea, meaning, they gotta show that for each charge, he was acting with the intention to bring about the conscious result of his actions, or that he was acting with a reckless mental state, respectively. I say that because self defense is considerably a valid exemption, and I wouldn’t think that it’d be too hard to plausibly make that argument here. Keeping that in mind, I don’t think he’ll be hit for counts 3 and 4, but the others seem more likely. Sorry if my typing is messed up or my sentence structure is out of wack, I’m drunk.
