Police are not automatically racist everytime they shoot a black person.

For the family that are already lawyered up with a civil rights lawyer that is the right move for them and their family. Whether race is involved or not as a family when this type of incident happens lawyer up! I'm not a lawyer nor have I ever had to use one but I listen and read a lot of true crime and one of the many many mistakes families make when violent cases are involved is they don't go after the police in time and usually get screwed over in the end because of this. Especially when it comes to civil rights and police botching the investigation. Most of the time this happened with an inexperienced or ill equipped police force that instead of bowing out to a police force that could handle the investigation they took it upon themselves to handle the case and did so poorly. The families in the end could not go after the police because they waited too long. This was usually under the assumption that those in charge of the case would complete the case and do a thorough job. But when mistakes happened like misplaced evidence, wrong cause of death, and misinformation released they couldn't go after them because they only had X amount of weeks ( time depends on state/country it happened in). A lot of this has changed as forensics and police training has improved but it's still a good idea right away so don't wait!
