According to the guidance provided in the FAQ section it states (in regards to speculative work)-

"Under these conditions, designers will often be asked to submit work under the guise of either a contest or an entry exam on actual, existing jobs as a “test” of their skill. In addition, the designers normally unwittingly lose all rights to their creative work because they failed to protect themselves by means of a contract or agreement."

I am not attempting to recruit employees by a "contest" nor am I asking for free work. I am offering an opportunity for someone to work on a project collectively with a group of like minded individuals and receive compensation in the form of payment upon the products' implementation in the consumer market. This project requires more than design and programming, and will involve field expertise to manage and promote effectively, which is why design and functionality are rewarded in the end. Individuals should have the option to determine whether their time is used effectively for any project they choose to participate in. That includes new devices and technology that may not be implemented immediately in the corporate environment.

I do not see anywhere in the rules that entities are not allowed to negotiate contracts with employees for payment upon completion of a project. Nor does it state that payment in the form of a percentage of future sales needs to be accompanied by an hourly wage. If I have missed something, please let me know, I am not attempting to be unfair with anyone, as such, the details of a contract will need to be evaluated on a case-by-case bases to ensure all parties are protected.
