It's my understanding, and I'll be happily corrected if wrong, that the usual standard for an indictment here is concrete evidence of intent to violate rules. You can see stories that suggest this in places like The Washington Post (which I'll trust more than NewsMax, for example). You can also see this phrasing in how Obama has very carefully parsed his words around the issue, "She would never intentionally put America in any kind of jeopardy.”.

So, to me, it seems like the crux of a possible indictment would be the ability to demonstrate intent and that, given the parties involved, there's very little likelihood of that occurring.

This is not a comment on my part about guilt or innocence, simply one on how the case seems to be shaping up and the standards for this type of inquiry that have been applied in the past. I'm curious as to what leads you to believe otherwise.
