I look at him and say ok, but I still don't want to have sex, he starts to kiss me again and lays me on his bed. I placed my arms around my breast and he removes them to kiss my breast, he gets on top of me and opens my legs, I again tell him no, I am not ready for sex.

There might be a syntax issue here. If she said "ok" and then just let him start, that's one thing (the implication being that she said "ok" to the sex itself), but she might have been trying to say that she spoke the entire phrase "ok, but I still don't want to have sex", which changes the map a bit. The latter most likely implies she simply consented to making out while they were naked. If it's the latter, according to that post, she actually told him that she didn't want to have sex three separate times. Sure, she enjoyed the kissing, but getting lost in the moment while kissing ≠ agreeing to full blown intercourse- especially when it's your first time and you're 17.

I'm not saying there isn't some grey area here (she might have given him mixed signals, kissing back and stuff during the sex itself out of awkwardness and not wanting to upset him, etc) but I think that 2-3 clear statements of "I don't want to have sex" coupled with crying and shaking means that you can't really write this off as "not rape". At best it's a "maybe he somehow perceived the entire situation vastly differently from her".
