Everything described here is one if those odd cases where legally it is not illegal. Courts have ruled mere nudity us not explicit sexual content. Even on cases of minors, nudity does not cross the threshold of sexual content...HOWEVER, just because something isn't illegal doesn't mean a prosecutor can't charge you.. Think a guy with some weed being charged as a drug trafficker the prosecutor knows it won't stick but it's charge first settle for the lowest you can prove beyond a reasonable doubt ....because they know Johnny charged with child porn is going to Plea so fast to make it go away it's not even funny...many of these cases never make it to trial as to avoid embarrassment...those that have often times get knocked down by judges or on appeal. Some states do have more stringent laws however they violate the first amendment and would be overturned on appeal... But seriously who's going to challenge child porn laws or cases... Most people don't read beyond "charged with child porn" and thus these cases of 16 yr old being charged for pics of themselves or nudity generally go unnoticed. Most never get beyond a plea deal. Where they they nail is when one is an adult and the other a minor or the pics depict sexual content. But long story short by constitutional interpretation by the SCOTUS mere nudity is not obscene or pornography as it does not constitute explicitly sexual content.
