suing a lawyer

I advised my lawyer that CMHC inspector did inspection of work under residential rehab program. he passed it all and his written report and verbally to me indicated good workmanship and 2 minor deficiencies in the building code, reconfirmed over the phone with my rrap agent. I released payment to contractor based on this. There are more code violations and the disabled portion a total failure. I lost all value in my home. I lost my job with the federal gov't because the reno's not being done correctly prevented a return to work within the 2 year period on ltd so i was forced into medical retirement. I could not move to another place to mitigate damages as cmhc loan required i continue to live in the home for 5 years. was advised by my lawyer no cause of action.He said no duty of care owed. flash forward to benoit v banfield. different program same concept first time tested duty of care in court.

The statute of limitations expired shortly after the lawyer quit because he was 1. so insulted I tried to explain this to him, and 2 I had no cause of action now in even my original claim which up until his bid to broker a joint expert agreement was for the 3rd time refused by the contractor( I was to pay him 33.3% or roughly 33k of the settlement amount and the cost of the expert and dispersments etc in the contract he proposed to me 7 weeks in. he quit before any discussion was made as to the terms and an agreement was never signed. I was not at any point advised that I was free to leave the situation. Since he had refused my instruction to file for default that limitation time was also exceeded. I was extremely disable in pain at the time both physically and mentally and knew I could not pursue any of this myself. He also told me he would in lieu of default, change the pleading to fraud and put a cpl on. This is what baffled me for so long as to why he wouldnt pursue the summary judgment he told me he would do either. Because of my disabilities, I totally relied on his advice and although the original claim has been kept alive through a series of notices of intention to proceed (since 2007) and the clause allowing the running of the limitation period to stop running while I am disabled much like in Benoit I cant find representation since he left as the first thing potential lawyers ask me is why he no longer represents me.
