Warranty periods for replacement products

TLDR; if you ever have trouble with warranty refer to Aus consumer law and back up the Panasonic 5 year tv case. With ACL your call technically get goods replaced for at least a decade.

Hey there, coming from someone who has studied consumer law/ works in multi tech brand distribution. For me I’ve had Apple replace a phone after warranty was over, and with my replacement my warranty has be reissued for 24months.

Warranty in Australia is technically not warranty, it’s proper name is VOLUNTARY warranty. Australians actual warranty is consumer guarantees, which is Australian Consumer Law (ACL), and more technical consumer statutory rights.

Fun fact, under AUS law, a business is not required to provide warranty. A warranty is a voluntary promise offered by the person or business who sold the product or service to you. So the timeframe of the period is up to them. Another fun fact, warranty and store refund policies all fall under voluntary warranties.

Depending on the terms and conditions, these warranties may entitle consumers to a refund, replacement or repair if there is a problem. also, a lot of companies try to get people to buy extended warranty, but basically THIS IS WHERE ACL COMES IN!

The consumer law states that:

Consumers have the right to ask for a repair, replacement or refund for goods that are faulty, unsafe, look unacceptable, or don't work the way that they're supposed to.

Australian consumers are entitled to a refund or replacement for a major failure and compensation for any other reasonably unexpected loss or damage.

Consumers are also entitled to have goods repaired or replaced if they are not of acceptable quality, even if there is no major failure. For minor issues, businesses may choose whether to repair, refund or replace the faulty item, and any repairs must happen within a "reasonable time frame".

For major problems, consumers are given the choice between a replacement or a full refund.

TO ACTUALLY ANSWER YOUR QUESTION:

It is up to a business whether they restart your warranty as it’s technically voluntary. Usually a more global company would, such as Apple.

However under ACL the replacement will be covered under statutory rights. Meaning your “reasonable time frame” will begin again once you have a product replaced. However another point to mention, if you product is repaired under ACL then usually the reasonable time frame will be from original purchase.

ACL uses the term “reasonable timeframe” which a lot of businesses try to use in there favour. They usually say it’s been 5 years, it’s old and been used. However If you refer to the Panasonic ACCC case where was argued that it is reasonable for TV to last more than 5 years. End user won the case, his tv was 9 years old and got a % discount per year of use as well.
