sigh. once again (say it with me now) Gawker was not criminally prosecuted (now say it one more time!) ... okay, technically the statutes under which the court chose to award damages to Hogan could be called "laws," but in the context of this thread that's not what we're talking about.

in your example, in my state, two-party consent is required; if you did what you posted, not only could i sue you for monetary damages, but you would also potentially be facing prison time. but those laws vary from state-to-state. nothing Gawker did was "criminal" in the sense that anyone was going to go to prison over it. the court order they violated was a temporary injunction while the case was proceeding, & their violation of it never got far enough, legally, before the case was decided. no one went to jail. no one's going to jail. if you think that i'm lying about that, cite sources.

though to be honest, i don't give a fuck about Gawker or Hogan. really, i don't. i have strong feelings about this case for the following reasons:

(1) what Thiel did, using Hogan as proxy, was objectively unethical. Peter Thiel has no interest in Hogan, yet he used the force of millions of dollars to allow Hogan to fight the case because Thiel didn't like things that Gawker printed. this does NOT mean i'm saying "Gawker's great! we should love them!" ... this means i'm saying "having millions of dollars shouldn't allow you to silence the press."

(2) this sets a precedent for other billionaires to do the exact same thing to other media outlets. example: HuffPo gets a tip that a silicon valley billionaire sexually harasses his female staff. do they report it? that's important info for consumers & investors to know (or at least i don't want to support someone like that!) ... but HuffPo risks, with that report, financial ruin & unemployment of all their writers. should they be forced to decide?

full & free press, or billionaires dictating what we hear about in the news? which would you rather? because you don't get both, & personally i think billionaires run enough of our society as it is.
